PRIVACY POLICY AND COOKIE STATEMENT
FOLC cares a lot about your privacy. We therefore only process data that we need for (the improvement of) our services and handle the information we have collected about you and your use of our services with care. We never make your data available to third parties for commercial purposes. This privacy policy applies to the use of the website and the services provided by FOLC. These conditions are valid starting 10/11/2021, the publication of a new version supersedes all previous versions.

This privacy policy describes the type of information we collect about you, what this information is used for and with whom and under what conditions this information can possibly be shared with third parties. We also explain to you how we store your data and how we protect your data against misuse and what rights you have with regard to the personal data you provide to us.

Below you can read how we process your data, where we store it or have it stored, the security techniques we use and for whom the data is transparent.

WEBSTORE SOFTWARE
Shopify
Our web store is developed with Shopify software. Personal data that you makes available to us for the improvement of our services will be shared with this party. Shopify has access to your data to provide us (technical) support, they will never use your data for any other purpose. Shopify is obliged to take appropriate security measures based on the agreement we have in place with them. These security measures include the application of SSL encryption and a strong password policy. Shopify uses cookies to collect technical information related to your use of the software, no personal data is collected and/or stored. Shopify reserves the right to share collected data within its own group to further improve the service.

EMAIL AND MAILING LISTS
MailChimp
We send our email newsletters with MailChimp. MailChimp will never use your name and email address for its own purposes. You will find the 'unsubscribe' link at the bottom of every email that is sent automatically via our website. You will then no longer receive our newsletter. Your personal data is stored securely by MailChimp. MailChimp uses cookies and other internet technologies that make it clear whether emails are opened and read. MailChimp reserves the right to use your data to further improve the service and to share information with third parties.

HOSTNET
We use the services of Hostnet for our regular business email traffic. This party has taken appropriate technical and organizational measures to prevent misuse, loss and corruption of (y)our data as much as possible. Hostnet has no access to our mailbox and we treat all our email traffic confidentially.

PAYMENT PROCESSORS
MOLLIE & SHOPIFY PAYMENTS
We use the Mollie & Shopify Payments platform to handle (part of) the payments in our web store. Mollie & Shopify Payments processes your name, address and residence details and your payment details such as your bank account or credit card number. Mollie & Shopify Payments has taken appropriate technical and organizational measures to protect your personal data. Mollie & Shopify Payments reserves the right to use your data to further improve the service and to share (anonymized) data with third parties. All the above mentioned safeguards with regard to the protection of your personal data also apply to the parts of Mollie & Shopify Payment's services for which they engage third parties. Mollie & Shopify Payments does not store your data for longer than allowed in accordance with the legal terms.

SHIPPING AND LOGISTICS
SENDCLOUD (PostNL & DHL)
When you place an order with us, it is our job to have your packagedelivered to you. We use the services of Sendcloud to carry out the dilveries.It is therefore necessary that we share your name, address and residencedetails with Sendcloud. Sendcloud uses this information only for the purpose ofexecuting the agreement. In the event that Sendcloud engages subcontractors,Sendcloud will also make your data available to these parties.

PICQER
Picqer is a warehouse software for E-commerce. It is therefore necessarythat we share personal data with Piqcer. Piqcer uses this information only forthe purpose of executing the agreement.

INVOICING AND ACCOUNTING
EXACT ONLINE
We use the services of Exact Online to keep track of our administration and accounting. We share your name, address and residence details and details regarding your order. This data is used for issuing sales invoices. Your personal data is sent and stored protected, Exact Online has taken the necessary technical and organizational measures to protect your data against loss and unauthorized use. Exact Online is bound by the privacy policy and will treat your data confidentially. Exact Online does not use your personal data for purposes other than described above.

GENERAL PURPOSE OF PROCESSING
We only use your data for the purpose of our services. This means that the purpose of the processing is always directly related to the assignment you provide. We do not use your data for (targeted) marketing. If you share data with us and we use this data to contact you at a later time - other than at your request - we will ask you for explicit permission. Your data will not be shared with third parties, other than to meet accounting and other administrative obligations. These third parties are all bound to privacy terms on the basis of the agreement between them and ourselves or an oath or legal obligation.

AUTOMATICALLY COLLECTED DATA
Data that is automatically collected by our website is processed with the aim of further improving our services. This data (for example your IP address, web browser and operating system) is not classified as personal data.

COOPERATION IN TAX AND CRIMINAL INVESTIGATION
Where appropriate, FOLC may be required to share your information in connection with government tax or criminal investigations on the basis of legal compliance. In such a case we are forced to share your data, but we will oppose this within the possibilities that the law offers us.

STORAGE PERIODS
We keep your data as long as you are a client of ours. This means that we keep your customer profile until you indicate that you no longer wish to use our services. If you indicate this to us, we will also regard this as a request to forget your data. Based on applicable administrative obligations, we must keep invoices with your (personal) data, so we will keep this data for as long as the applicable term runs. However, employees no longer have access to your client profile and documents that we have produced as a result of your request.

YOUR RIGHTS
Pursuant to the applicable Dutch and European legislation, you as a data subject have certain rights with regard to the personal data processed by or on behalf of us. We explain below which rights these are and how you can invoke these rights.

In principle, to prevent misuse, we will only send confirmation and copies of your data to your currently known email address. If you wish to receive the data via a different email address or, for example, by post, we will ask you to identify yourself. We keep records of completed requests, in case of a forget request we administer anonymized data. You will receive all confirmation and copies of data in the machine-readable data format that we use within our systems. You have the right to submit a complaint to the Dutch Data Protection Authority at any time if you suspect that we are using your personal data incorrectly.

RIGHT OF INSPECTION
You always have the right to view the data that we process or have processed that relates to your person or that can be traced back to you. You can make a request to that effect via our contact person for privacy related matters. You will receive a response to your request within 30 days. If your request is granted, we will send you a copy of all data using the email address known to us, with an overview of the processors who have this data, stating the category under which we have stored this data.

RECTIFICATION RIGHT
You always have the right to insight into the data that we (have) process(ed) or that relates to your person or that can be traced back to this. You can make a request to that effect through our contact person for privacy related matters. You will receive a response to your request within 30 days. If your request is granted, we will send you a confirmation that the details have been changed using the email address known to us.

RIGHT TO RESTRICT PROCESSING
You always have the right to limit the data that we (have) process(ed) that relates to your person or that can be traced back to you. You can make a request to that effect through our contact person for privacy related matters. You will receive a response to your request within 30 days. If your request is granted, we will send you a confirmation to the email address known to us that the data will no longer be processed until you remove the restriction.

RIGHT TO TRANSFERABILITY
You always have the right to have the data that we (have) process(ed) that relates to your person or that can be traced back to this, be carried out by another party. You can make a request to that effect through our contact person for privacy related matters. You will receive a response to your request within 30 days. If your request is granted, we will send you confirmation and copies of all data about you that we have processed or that have been processed on our behalf by other processors or third parties, via the email address known to us. Likely we can no longer continue the service in such a case because the secure linking of data files can then no longer be guaranteed.

RIGHT TO OBJECT AND OTHER RIGHTS
Where appropriate, you have the right to object to the processing of your personal data by or on behalf of FOLC. If you object, we will immediately stop the data processing pending the processing of your request to object being completed. If your request is well-founded, we will provide you with confirmation and/or copies of data that we (have) process(ed) and then permanently discontinue the processing. You also have the right not to be subject to automated individual decision-making or profiling. We do not process your data in such a way that this right applies. If you believe that this is the case, please contact our contact person for privacy related matters.

GOOGLE ANALYTICS
Through our website, cookies are placed from the American company Google, as part of the 'Analytics' service. We use this service to keep track of and get reports on how visitors use the website. This processor may be obliged to provide access to this data under applicable laws and regulations. We have not permitted Google to use the analytics information obtained for other Google services.
